Agreement to these terms
These Terms of Service (“Terms”) govern your use of yourdayschedule.comand the related applications, features, and services (together, the “Service”). The Service is provided by Edubookings.com LLC, a limited liability company based in Miami, Florida, United States(“YourDay,” “we,” “us,” or “our”).
By creating an account or booking a meeting through a YourDay page, you agree to these Terms. If you do not agree, do not use the Service. If you use YourDay on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
The service
YourDay lets professionals (“hosts”) publish booking pages, collect intake information and documents, sync calendars, generate meeting links, take payments, and use optional AI features — including meeting-prep briefs, transcription and summaries, and follow-up drafts. People who book meetings with a host are “clients.”
We are continually improving the Service and may add, change, or remove features over time. We may also set or change limits on use, or suspend or discontinue parts of the Service, with notice where practicable.
Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you are 18 or older and that the information you provide is accurate. The Service is not directed to, and may not be used by, children under 18.
Accounts
You are responsible for your account credentials and for all activity that happens under your account. Provide accurate information, keep it current, and keep your password secure. Notify us promptly if you believe your account has been compromised.
We may suspend or limit accounts that violate these Terms, that create risk or possible legal exposure for us or others, or that remain inactive for an extended period.
Subscriptions & platform fees
Some features of the Service require a paid subscription. If you purchase a subscription, you agree to pay the fees and applicable taxes for your plan. Unless stated otherwise, subscriptions renew automatically for successive periods until cancelled, and fees are non-refundable except where required by law.
We may change our fees or introduce new charges; we’ll give you advance notice, and changes take effect at your next renewal. You can cancel at any time in your account settings, and cancellation takes effect at the end of the current billing period. Platform subscription fees are billed by YourDay and are separate from any payments between a host and their clients.
Payments between hosts and clients
Hosts may charge clients for meetings through Stripe or Square. Those payments are processed on the host’s own processor account.
The agreement to pay for a meeting is between the host and their client. YourDay does not receive those funds and is not responsible for them. Refunds are issued by the host through the app or their processor dashboard, in line with the host’s own policies.
Connected services
Hosts may connect third-party services — including Google, Microsoft, Zoom, Apple iCloud, Stripe, Square, and Zapier. Your use of each connected service is also governed by that provider’s own terms.
You authorize YourDay to access connected services on your behalf solely to provide the features described in the app, and you can disconnect them at any time in Settings, which deletes the stored credentials.
Your content
You retain ownership of the content you submit — booking details, documents, transcripts, notes, and similar materials (“Your Content”). You grant us the limited, non-exclusive license needed to host, store, process, transmit, and display Your Content for the purpose of operating and improving the Service.
You are responsible for having the rights to the content you upload and for complying with the laws that apply to it.
Meeting types with the transcription notice enabled tell clients their meeting “may be transcribed” and let them opt out during booking. If a client opts out, we notify you on the booking and in the calendar event. As between you and Your Day Schedule, you are solely and exclusively responsible for your recording and transcription of meetings, including honoring any opt-out and complying with all applicable call-recording, wiretap, consent, and data-protection laws (including one- and two-party consent statutes, the GDPR, and the CCPA/CPRA) in your jurisdiction and the jurisdictions of your participants. If you enable Meeting Listener, you represent and warrant that you have all rights, permissions, and legally required consents necessary for recording and transcription before initiating or permitting any recording or transcription. Your Day Schedule does not authorize or instruct any user to record or transcribe a meeting without obtaining any consent required by applicable law. Recording or transcribing a meeting contrary to a participant’s opt-out, or without any consent required by law, constitutes a breach of these Terms and an unauthorized use of the Service. To the maximum extent permitted by law, Your Day Schedule assumes no legal responsibility and disclaims all liability for any such recording or transcription, and any resulting claims, damages, fines, or penalties rest solely with you (see Sections 15 and 16).
AI features
AI-generated content — prep briefs, transcription summaries, follow-up drafts, and analytics — is produced automatically and may contain errors or omissions.
Always review AI-generated content before relying on it or sending it to a client. It is provided to assist you, not to replace your judgment, and it is not professional, legal, financial, or medical advice.
Acceptable use
When using the Service, you agree not to:
- Use the Service for any unlawful, deceptive, fraudulent, or abusive purpose.
- Send spam or unsolicited messages, or harvest contact information without permission.
- Attempt to breach security, probe or scan the Service, or access another tenant’s data.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer or copy the Service except as permitted by law.
- Resell, sublicense, or commercially exploit the Service without our written consent.
Our intellectual property
The Service — including its software, design, text, graphics, logos, and the “YourDay Schedule” name and brand — is owned by Edubookings.com LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted to you.
Feedback
If you send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose without obligation or compensation to you.
Third-party services & links
The Service may integrate with or link to third-party services and websites that we do not control. We provide these for convenience and do not endorse them or assume responsibility for their content, products, or practices. Your use of any third-party service is governed by that party’s own terms and privacy policy.
Disclaimers
Limitation of liability
Indemnification
You agree to indemnify and hold harmless Edubookings.com LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, your violation of these Terms, or your violation of any law or the rights of a third party — including any consent obligations for recording or transcribing meetings. For clarity, this indemnity covers any claim, fine, or penalty arising from your recording or transcription of a meeting without legally required consent or contrary to a participant’s opt-out.
Termination
You may stop using the Service and request account deletion at any time by contacting support@yourdayschedule.com. We may suspend or terminate your access for breach of these Terms, with notice where practicable.
On termination, your right to use the Service ends. Sections that by their nature should survive — including content licenses you’ve granted for feedback, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
Governing law & dispute resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Subject to the section below, you agree that the state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction over any dispute that is not subject to arbitration.
Before filing a claim, you agree to contact us at support@yourdayschedule.comso we can try to resolve it informally. If we can’t, any dispute will be resolved by binding individual arbitration rather than in court, except that either party may bring a claim in small-claims court. TO THE EXTENT PERMITTED BY LAW, YOU AND YOURDAY WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Some jurisdictions do not allow certain of these limitations, so they may not apply to you.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we’ll announce them in the app or by email and update the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
General
- Entire agreement. These Terms, together with our Privacy Policy and Service Level Agreement, are the entire agreement between you and YourDay regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions stay in full effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may provide notices to you by email or in the app; you may reach us at the contact below.
